1. Who we are
AgreeReady is a trading name of Split Right Ltd, a company registered in England and Wales (company number 17351365), whose registered office is at [registered office address]. You can contact us at hello@agreeready.com.
2. What AgreeReady is and what it is not
AgreeReady provides online tools that help couples in England and Wales prepare their own pre-nuptial, post-nuptial and cohabitation agreements and pet-nups, together with general information about the law on those agreements.
- AgreeReady does not give legal advice. The tools and information are general. They do not take account of all the facts of your situation and are not a substitute for advice from a qualified lawyer. An agreement signed without independent legal advice on each side is much easier to challenge.
- No lawyer acts for either of you. Using AgreeReady does not create a lawyer–client relationship. No solicitor or barrister reviews the agreement you create. The certificates of independent legal advice included with each agreement are for the advisers you each choose to complete.
- AgreeReady is independent. It is not part of, or approved by, the court, HM Courts & Tribunals Service, the judiciary or any regulator.
- We do not act for you. We do not negotiate between you, witness signatures, register or hold your agreement, or correspond with anyone on your behalf.
- No reserved legal activities and no regulator. Split Right Ltd does not carry on any activity reserved to lawyers by the Legal Services Act 2007. It is not authorised or regulated by the Solicitors Regulation Authority, the Bar Standards Board or CILEx Regulation and is not within the Legal Ombudsman scheme. The founder is a practising barrister regulated by the Bar Standards Board in her own practice; she does not advise, accept instructions or act for anyone through AgreeReady.
- No guarantee that an agreement will be upheld. In England and Wales no nuptial agreement is binding on the court, and whether any agreement is enforced depends on how it was made, what it says and the circumstances when it is relied on. We do not guarantee any outcome.
If you are unsure about any aspect of your agreement, take independent legal advice. Our legal disclaimer says more about what AgreeReady is and is not.
3. Your responsibilities
- You are responsible for the information you enter. The agreement and its schedules are only as accurate as the figures and facts you both provide.
- You must each check every figure and every clause before you sign and make sure it is true, complete and up to date. An agreement based on incomplete or inaccurate disclosure may be set aside.
- Both parties must enter their own information or approve what the other has entered. You must not enter another person's details without their knowledge and agreement.
- You are responsible for taking independent legal advice, for signing the agreement properly as a deed in front of a witness and for keeping the signed original safe. We do not keep a copy.
- You must not use AgreeReady for other people's agreements in return for payment unless you buy for your work under the terms below. Nobody may copy, resell or reverse-engineer the service.
4. Your information stays on your device
The case file you build is stored in your own web browser and in any case file you choose to save to your device. It is not sent to us. If you clear your browser's data or use a different device, you will need your saved case file to continue. See our privacy notice.
5. Prices and payment
- Prices are shown on the website before you buy. One price covers the agreement for both of you. Split Right Ltd is not registered for VAT, so no VAT is charged on our prices.
- Payments are taken by our payment provider, Stripe. We do not see or store your card details.
- An agreement is for use by the two people named in it.
How long your purchase lasts
- Access period. When you buy an agreement, you can build, change and download it for 42 days from the date of payment.
- Downloads. During the access period you can change your figures and wording on screen as often as you like. You can download or copy the agreement once for each purchase, so check every figure and every word on screen before you download it. We will remind you of this before the download.
- What you keep. The agreement you download is yours to keep, edit, take advice on and sign. It does not expire.
- After the access period or your download. The website will no longer let you download that agreement. If you need a new version, for example after a review, you can buy the agreement again at the price then shown.
- Your saved case file. The end of the access period does not affect the case file saved on your own device, which you can open again if you buy later.
- No refunds for a change of mind. Payments are not refundable if you change your mind, because the agreement is unlocked on screen as soon as you pay (see section 6). If the agreement is faulty we will fix it and if it cannot be put right you may be entitled to some or all of your money back (see section 7).
6. Your right to cancel
Our agreements are digital content, supplied online. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you would normally have 14 days to cancel. Supply begins the moment you pay, because the agreement you have bought is unlocked on screen at once and can be read, changed and copied from then on. For that reason we ask you, before you pay, to agree to immediate supply and to acknowledge that you lose your right to cancel as soon as the agreement is unlocked. You cannot pay without giving that agreement and once you have paid there is no right to cancel and no refund for a change of mind. This does not affect your rights if the agreement is faulty (section 7).
Wording shown at checkout: “I want my documents unlocked now. I understand that I lose my 14-day right to cancel once they are unlocked.” You are also shown, beside that box, our policy: no refunds if you change your mind; faulty documents fixed; statutory rights unaffected.
7. If something is wrong with an agreement
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If there is a fault with an agreement we supply, tell us what is wrong (section 10 says how) and we will make sure it is fixed for you. Our "no refunds" policy is about changing your mind; it does not take away the rights the Act gives you if a fault cannot be put right (which may include a price reduction or a refund of some or all of the price) and nothing in these terms affects your legal rights as a consumer.
8. Our responsibility to you
- We will provide the service with reasonable care and skill and keep our templates in line with the current law and practice on nuptial and cohabitation agreements.
- The Agreements and the law page, the Definitions and the FAQ are general information, checked against official sources and reported cases on the dates shown. They may contain errors or become out of date and they are not advice on your situation. Check anything important with your own adviser.
- We cannot guarantee that a court will uphold your agreement or how it will be treated if your relationship ends. That depends on the law at the time, how the agreement was made and your circumstances then.
- We are not responsible for loss caused by incorrect or incomplete information either of you provides, by a failure to check the agreement, by a failure to take independent legal advice, or by the agreement not being signed and witnessed properly.
- We are not responsible for losses that were not foreseeable when you bought from us, or for business losses.
- Subject to the next point, our total responsibility to you is limited to the price you paid for the product concerned.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
If you buy for your work
Most of our customers are couples preparing their own agreement and these terms are written for them. If you buy as a solicitor, barrister, mediator or other professional, or otherwise in the course of a business, the following also apply: the consumer cancellation rights in section 6 and the Consumer Rights Act 2015 rights in section 7 do not apply to you; you remain responsible for checking every clause and figure against your clients' instructions and the law; you must not enter a client's details into the tool without the client's authority and our privacy notice explains that the information stays on your device; and our total responsibility to you is limited to the price you paid for the product concerned, except for anything that cannot be limited by law.
9. Intellectual property
The AgreeReady name and logo are trade marks of Split Right Ltd (applications pending). The website, its text, its templates and its design belong to Split Right Ltd. The paintings and the sparrows in our logo are by Rosie Dilys and are used under licence. The agreement you create is yours to use between the two of you or, if you buy for your work, for your clients.
10. Complaints
If you are unhappy, email complaints@agreeready.com with your name, what went wrong and what you would like us to do. We will acknowledge your complaint within 5 working days and give you a full response within 14 days. If you are not satisfied with our response you may refer the matter to a certified alternative dispute resolution body or to the courts; because Split Right Ltd is not a law firm, the Legal Ombudsman cannot consider complaints about it. See Contact us.
11. Changes and general terms
- We may update these terms. The version that applies is the one on the website when you buy.
- If any part of these terms is found to be unenforceable, the rest remains in force.
- These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can also bring proceedings in your local courts.
